PRIVACY POLICY

1. Introduction

This Privacy Policy explains how the Wisconsin Dental Association, Inc., a Wisconsin non-stock corporation, and its subsidiaries, charities and affiliated entities (collectively, the “WDA”), collects, uses, shares and safeguards Personal Data and Non-Personal Data on wda.org, mobile websites, mobile applications, WDA profiles on WDA social media sites and any other digital services and platforms officially operated or used by the WDA from time to time (“Sites”), as well as by phone or by paper. This Privacy Policy does not apply to websites that do not display or link this policy or have their own privacy notices. 

2. Changes to the Privacy Policy

As the WDA, its membership, products and services change from time to time, this Privacy Policy is expected to change as well. We reserve the right to amend the Privacy Policy at any time, for any reason. The date of the last revision to the Privacy Policy will be indicated by the "Effective Date" at the bottom of this page.

3. Types of Data We Collect

Personal Data

We collect information (whether online, by phone, by paper, or through the American Dental Association, an Illinois not-for-profit corporation (the “ADA”)) that enables the WDA to identify or contact you (“Personal Data”) to carry out its business purposes.  WDA Sites collect this information for a variety of business reasons, including but not limited to, applying for membership, registering for an WDA event or program, purchasing WDA products or services, or otherwise interacting with the WDA.

The types of Personal Data we may collect include, but are not limited to:

•    General data (e.g., names, dates of birth, home and business addresses, email addresses, Internet protocol addresses and mobile/landline business/personal telephone numbers that are provided by our members/customers);
•    Professional data (e.g., dental school graduation, graduation date, licensing, number, date and state(s));
•    Other identification information (e.g., photographs);
•    Financial information (e.g., credit and debit card numbers, credit reports, passwords and PIN numbers) for product sales or employment purposes; and
•    Sensitive Personal Data (e.g., race, ethnic origin, or disability data) as, at each Site user’s choice, submitted to and collected by the ADA for diversity or accessibility purposes.

The WDA also receives Personal Data from third parties for the WDA’s use in in accordance with this Privacy Policy, such as access to lists of licensees or professionals from the ADA.

Non-Personal Data

We collect information (whether online, by phone, or by paper) that does not directly identify you as you interact with our Sites (“Non-Personal Data”). The types of Non-Personal Data we collect includes, but is not limited to:

•    Site usage (e.g., browsing history, search terms, number of clicks, referring/exit pages, date/time stamp, time on Site)
•    Products and services viewed, including advertisements for such products and services
•    Computer type, operating system and platform type
•    Internet service provider
•    Your industry and business (e.g., company size and location, job functions and seniority levels)

4. How We Use Your Data

In addition to the uses described above, we use your Personal Data, sometimes combined with Non-Personal Data, in order to:

•    Identify you when you visit the Sites;
•    Provide transactional service communications such as bill reminders, order confirmations, program registrations and customer service messages;
•    Process transactions and provide products, information and services you request or that we think you may be interested in, or in order to respond to your emails regarding the same;
•    Deliver and process surveys regarding the practice of dentistry and WDA membership activities;
•    Personalize and improve the functionality of the Sites;
•    Fulfill and/or deliver products and services;
•    Tailor content, advertising and marketing to your specified interests, memberships, and/or practice areas; and
•    Publish publicly available and internal membership directories, membership lists and registration lists on the Sites and/or in print and digital media. In the case of publicly available directories and lists, you will be required to provide consent in order to be included.

This list of uses for Personal Data is non-exhaustive, and there may be additional business uses, for which we will obtain your prior consent.

Non-Personal Data

We use Non-Personal Data to improve the usability of our Sites and for other business reasons. We or other third-party companies also use Non-Personal Data to provide advertisements and targeted advertisements to you (ads based on the Non-Personal Data). We do not provide Personal Data to third parties with whom we share your Non-Personal Data. Please note that, when you select an advertising link or other link that takes you to sites not operated by the WDA, you may be subject to the privacy policies of these third-party sites.

5. How We Share Your Data

We share your Personal Data, sometimes combined with Non-Personal Data, in a variety of ways including, but not limited to the below:

•    We may share your data with third parties, including the ADA, to fulfill service requests and to perform business functions. The WDA often contracts with third parties to provide services on our behalf, such as credit card and payment platform services; data hosting services; packaging, mailing and delivering services; customer support and consulting services; and event registration and management services. 

•    We may share your data with regulators, governmental agencies; legal representatives; or other third parties as required by law or to protect the WDA in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on the WDA; (b) protect and defend the WDA’s rights or property; or (c) protect the personal safety of WDA personnel or members of the public in appropriate circumstances.

•    We may share your data with third parties if the WDA and/or its assets (or a portion of its assets) are sold, assigned, transferred, or merged, or if the WDA undergoes some other change including a change to its corporate form as part of a bankruptcy proceeding or otherwise; information may be transferred as part of that transaction or change.

•    We may share your data with third parties to offer you products and services that may be of interest to you professionally or personally (e.g., membership renewal notices; products and services, including upcoming conference and/or CLE opportunities; business software solutions; or member product discounts).  Users can request their information be removed from such lists by contacting us, as set forth in the “Contact Information” section below.

•    We may share your data with social media sites, such as Facebook, LinkedIn, X (formerly known as Twitter), You Tube, Instagram, and others who may contact you with “targeted ads” relating to dental and other services.

In addition to these instances, we may share your data with third parties under other unanticipated situations, but only with your prior consent.  In any manner in which the WDA is sharing your data, we will take every effort to comply with all applicable statutes and regulations, including all applicable state regulations and the EU General Data Protection Regulation.

6. How We Share Your Email Address

You may receive email communications regarding upcoming programs, services or events that align with your expressed interests.  However, the WDA does not sell or rent your email addresses to any party outside of the WDA, except in certain circumstances for the purpose of conducting WDA or ADA business. No email address that you provide to the WDA will be shared with corporate sponsors, advertisers, member benefits providers, insurance providers, or any third-party selling products and services on the WDA’s behalf without prior consent. 

7. How We Use Your Mobile Information

Upon electing to the “mobile phone opt-in” in your ADA profile, you may receive informational SMS or text messages from the WDA in order to achieve our normal business purposes. We will only text you with important information and reminders about WDA membership, events, programs, or deadlines. The WDA does not use your mobile information for marketing/promotional purposes without prior consent. Further, no mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the stated categories in this privacy policy exclude text messaging regarding originator opt-in data and consent.

SMS Terms

You can opt-out of SMS or text messages by replying STOP. Message frequency varies. Message and data rates may apply.

8. How You Can Manage the Processing of Your Data

You can manage your profile and email preferences, including “opting out” of email by logging into the WDA website (which will direct you to the ADA website) and editing your profile, or by contacting the WDA Main Office using the information in the “Contact Information” section below. If you prefer to receive hard copy mailings only from the WDA, you can contact us and request to have your name and address removed from any lists we provide to third parties. For California residents, please consult the “California Privacy Rights” section for additional considerations. 

Our processing of your data is based upon your consent, contract performance (e.g., your purchase of products or membership sign-up/renewal), legitimate business interest (e.g., direct marketing of goods and services), or compliance with law.  You have the right to object to our processing of your data or to restrict our processing of your data. In addition, if you have consented to the processing of your Personal Data, you have the right to revoke your consent at any time.  Should you revoke your consent, such revocation will be effective no later than 30 days after your request, unless an earlier date is required by law.

9. U.S. Privacy Law

While the US does not have a comprehensive data privacy law, we understand that there are various jurisdictions within the U.S. that have implemented their own laws, including opt-in provisions.  The WDA complies with all of those statutes and regulations as they pertain to the WDA.

10. Children

The WDA is geared towards credentialed dentists, dental professionals, and others interested in the practice of dentistry.  We do not knowingly market to, or collect Personal Data from, children under the age of 13.

11. How We Protect Personal Data

The WDA implements commercially reasonable security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. Except for membership directories, membership lists, registration lists, and the sharing of information as set forth in this Privacy Policy, we restrict access to Personal Data to certain companies who need the data to operate, develop, or improve our services. These individuals or partner organizations are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Unfortunately, no data transmitted over the Internet or stored electronically is fully secure. Accordingly, and despite our reasonable efforts to protect your Personal Data from unauthorized access, use, or disclosure, the WDA cannot guarantee or warrant the security of the Personal Data you transmit to us, or to or from our online Sites.  Accordingly, if you have issues in making a financial transaction online, please do not transmit your payment information to us via email, but contact the WDA Main Office at the number listed below.

12. User ID and Password

Certain areas of the Sites require the use of a user ID, email address, or password as an additional security measure that helps protect your Personal Data.  To help you protect your privacy, these Sites have tools to help you log in and log out.  In order to help us with our efforts to protect your data, we do ask that you take steps to change your password periodically and that you refrain from using the same passwords across sites.

13. Linking to Other Internet Sites

You should be aware that other internet sites that are linked from our the Sites or from an WDA email message may contain privacy provisions that differ from the provisions of this Privacy Policy. To ensure your privacy is protected, we recommend that you review the privacy statements of these other linked sites, applications, or other digital platforms.

14.  How You Can Access, Change and Delete Your Personal Data

We rely on you to update and correct your Personal Data.  If you are a user of our Sites, a subscriber to any WDA publications, a purchaser of any WDA products and services, or an WDA member, you can review, update and correct your information directly on the ADA’s website or by contacting us using the information in the “Contact Information” section below. Typically, we retain your Personal Data for the period necessary to fulfill the normal business use for which it was collected, unless a longer retention period is required or permitted by law. In some instances, this may include retaining your Personal Data indefinitely, even after you are no longer an WDA member.  Please note that you can request that we delete your Personal Data at any time.  All requests must be directed to the contact in the “Contact Information” section below.  We can elect to delete your Personal Data if we determine that the data is incomplete, inaccurate, or that our continued use and storage are contrary to our obligations to other members, individuals, or third parties.  We will delete your Personal Data where it is required by law.  When we delete your Personal Data, it will be removed from our active databases or anonymized so that the data is no longer identified with you, but the data may remain in our archives if the WDA determines that it is not practical or possible to delete it.

15. Cookies and Other Web Devices

What Are Cookies? 

Our website sends cookies, which are small pieces of code or text placed on your computer by us or third-parties when you browse our Sites, typically accessed from your web browser or your device’s memory. A cookie typically contains the name of the domain from which the cookie originated, the “lifetime” of the cookie, and a randomly generated unique numerical identifier.  A cookie may also contain information about your device such as subscriber settings, browsing history and activities conducted while using our services. 

Types of Cookies

First-party and third-party cookies
There are first-party cookies and third-party cookies. First-party cookies are placed on your device directly by us. For example, we use first-party cookies to better understand your use of our website. Third-party cookies are placed on your device by our partners and service providers. 

Session and persistent cookies

There are session cookies and persistent cookies. Session cookies only last until you close your browser. We may use session cookies for a variety of reasons, including to learn more about your use of our website during one single browser session and to help you to use our website more efficiently. Persistent cookies have a longer lifespan and aren't automatically deleted when you close your browser. These types of cookies are primarily used to help you quickly sign-in to our website again and for analytical purposes.

What do we use cookies for? 

Like most providers of online services, we use cookies to provide, secure and improve our services, including by remembering your preferences, recognizing you when you visit our website and personalizing and tailoring ads to your interests. To accomplish these purposes, we also may link information from cookies with other personal information we hold about you. When you visit our website, some or all of the following types of cookies may be set on your device.

How to control cookies?

You may opt-out of cookies. Cookie settings can be controlled through the browser pop-up or in your internet browser to automatically reject some forms of cookies.  If you view our Site without changing your cookie settings, you are indicating your consent to receive all cookies from our Sites.  If you do not allow cookies, some features and functionality of our Sites may not operate as expected. 

Some web browsers provide settings that allow you to control or reject cookies or to alert you when a cookie is placed on your computer. The procedure for managing cookies is slightly different for each internet browser. You can check the specific steps in your particular browser help menu. You also may be able to reset device identifiers by activating the appropriate setting on your mobile device. The procedure for managing device identifiers is slightly different for each device. Other Tracking Technologies
In addition to cookies, we may place technological tools (and allow certain third parties to place technological tools) such as tags and beacons (e.g., code scripts that are primarily used to track visitors’ activities on our Sites by web analytics software), Internet Protocol (IP) addresses, web beacons (also called pixel tags or clear gifs), tracking URLs or software development kits (SDKs), or other tools, to collect your data for the purposes listed in this Privacy Policy.

16. Transmission of Data to Other Countries

Your Personal Data is processed in the United States, where privacy laws may be less stringent than the laws in your country and where the government, courts, or law enforcement may be able to access your data.  By submitting your Personal Data to us, you agree to the transfer, storage and processing of your Personal Data in the United States.

17. Right to Complain to Supervisory Authority

You, as the data subject, have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement, if you believe that the processing of your personal data does not comply with legal requirements.

18. Breach Notification

In the event we determine the occurrence of a data security incident, we will notify you by email, US mail, telephone, or other means as permitted by law.
